摘要
金融反恐,是指任何国家以任何合法手段,发掘恐怖主义资金的来源和流向,进而切断恐怖主义的资金来源,追踪恐怖组织和恐怖分子,以遏制恐怖活动发生的反恐行为。金融反恐的基本措施大体上可分为两类:一类是偏重于"打击"的直接措施,具体包括将恐怖融资行为犯罪化,实施涉恐资产冻结等金融制裁,以及严厉打击非法恐怖融资活动;另一类是偏重于"预防"的间接措施,具体包括防止滥用金融和特定非金融机构,防止滥用慈善机构等非营利组织,以及加强金融情报机构建设,推动恐怖融资情报共享。
Combating the financing of terrorism refers to the discovery of the source and flow of terrorist funds through any legal means,thereby cutting off the sources of terrorist funds,tracing terrorist organizations and terrorists to curb terrorist activities.The basic measures for combating the financing of terrorism can be broadly divided into two categories:one is direct measures that focus on"strike",including criminalizing terrorist financing,freezing terrorist assets,and cracking down on illegal terrorist financing activities;the other is indirect measures that focus on"prevention",including preventing the misuse of financial intelligence and designated non-financial businesses and professions,preventing the misuse of charities and other non-profit organizations,strengthening the construction of financial intelligence institutions,and promoting the information sharing.
