高校学生权利的正当性反思——基于92所“双一流”建设高校章程文本的分析

摘要 大学章程是学生权利得以实现的重要制度保障。从实体正当和程序正当两个层面对92所“双一流”建设高校的章程文本进行分析后发现,大学章程在保障学生权利方面发挥了重要作用的同时也存在诸多不足:重要权利存在缺损且回应时代关切不足,学生权利保障空心化且移植多于专门设计,学生权利表述人本性因素彰显不足;学生权利条款表述规范性欠缺或超越法律赋权,学生权利救济制度设计宣言化且缺乏可操作性,保障学生权利的程序性条款存在缺损。为此,大学章程应彰显以生为本诉求,提升主体价值认同;完善实体权利内容,健全学生权利图谱;完善程序性条款,确立程序正当;提高制章技术,加强核准实效。 From the substantive justice and procedural justice perspectives,this study analyses the texts of statutes of 92“double first-class”construction universities.It summarizes problems existing in the protection of student rights.These problems include the defects and insufficient response to the concerns of the times in the aspect of important rights,the hollowing-out of student right protection,which is more transplanted than specially designed,ultra vires or lack of human nature and standard ability in the clause expression,the declarative and inoperable design of student right relief system and the defects of procedural clauses.It perceives that university statutes should highlight the student-oriented appeals to enhance the identification of subject value,perfect the content of substantive rights and procedural clauses to establish the principle of due process and improve the statute construction technique to reinforce the approval effectiveness.
