摘要
网络诈骗作为电信诈骗的一种重要犯罪方式,影响了人们生活的方方面面,其中网络兼职诈骗犯罪带来的危害与日俱增,侵害了人民群众的财产安全,影响了人们的安全感和社会的和谐稳定。采用文献研究法、调查研究法、比较分析法等方法分析了传统电信诈骗犯罪与现阶段网络兼职诈骗犯罪的异同、公安侦查人员的侦查思维和其采取的侦查对策的不同,提出了网络兼职诈骗犯罪的特征、团伙组织架构和几种典型类型。并在此基础上从立法学、犯罪心理学、公安技战法等角度,提出了针对现阶段网络兼职诈骗犯罪的侦防对策。
As an important crime way of telecommunication fraud,network fraud has affected people’s life in all aspects.Among them,the harm of network part-time fraud is increasing day by day,which infringes people’s property security,affects people’s sense of security and social harmony and stability.This paper analyzes the similarities and differences between the traditional telecommunication fraud and the current part-time network fraud,the investigation thinking of the public security investigators and the investigation countermeasures adopted by them,and puts forward the characteristics,organization structure and several typical types of the part-time network fraud.On this basis,from the perspectives of legislation,criminal psychology,public security technology and war law,this paper puts forward the countermeasures against the crime of part-time fraud on the Internet at this stage.
