摘要
家庭教育的公共性和私人性是家庭教育政府职责的逻辑起点。政府责任理论、家庭教育的现实问题以及国外加强家庭教育建设的经验都要求政府承担对家庭教育的职责。家庭教育政府职责的定位在于提升父母的家庭教育能力。家庭教育的政府职责包括规划家庭教育事业发展、提供家庭教育服务、实施家庭教育指导、规范家长教育行为、监管家庭教育服务市场以及保障家庭教育公平。为了促进家庭教育政府职责法治化,我国应该立法明确公民的家庭教育权利,优化家庭教育行政组织,保障家庭教育政府财政投入,规范家庭教育行政方式与程序,建立家庭教育督导与问责制度,健全家庭教育权利救济机制。
The public and private character of family education is the logical point of governments’responsibility for family education.The theory of government responsibility,the predicament of family education in China and the experience of the construction of family education abroad have urged the government to take on the responsibility of family education.The government’s role in family education is to improve parents’family education ability.The governments’responsibilities for family education include making family education development plan,providing family education services,implementing family education guidance,forming parents’education behavior,regulating family education services and safeguarding the fairness on family education.In order to improve the level of rule of law on governments’responsibility for family education,we should confirm the citizen’s right to family education,optimize family education administrative organization,guarantee the government’s financial investment in family education,regulate administrative methods and procedures in family education,establish a family education supervision and accountability system and improve the family education right relief system.
