摘要
第二次世界大战后,残疾人受教育权成为国际法关注的重要领域,国际社会对与残疾人相关的问题逐步达成共识,形成了以《残疾人权利公约》为基础的国际残疾人权利保护的基本法律框架。本文从一般法和专门法两方面对国际法中的残疾人受教育权相关内容进行系统梳理,归纳出国际法中残疾人受教育权保护的宗旨与原则,并对近年来我国残疾人受教育权保护的实践进行阐述与分析,以期对残疾人教育事业的发展有所裨益。
After the Second World War,the disabled persons'right to education has become an important area in the concern of international law,and the international community gradually getting a consensus on disability-related issues,a basic legal framework of the protection of the rights of international disabled persons built on'Convention of the Rights of Persons with Disabilities'has formed.This paper makes a systematic review of the provisions on the right of disabled persons to education in international law from the perspectives of the general law and special law,summarizes the purpose and principle of the pro-tection of disabled persons'right to education in international law,and expounds and analyzes the practice of the protection of disabled persons'right to education in recent years,so that it will be beneficial to the development of the disabled education.
