摘要
监视居住制度设立的主要目的在于贯彻无罪推定理念,减少羁押性强制措施的适用,通过公安机关对犯罪嫌疑人进行监管,限制其一定的人身自由,以达到保障刑事诉讼顺利进行的目的。但由于其规定较为模糊,在实际执行过程中常常出现侵犯人权现象的发生。通过严格执法理念的引入,从树立严格完善法律规则、践行法律标准、严格规范执法权运行等方面为着力点,进一步提出针对性的解决方案,帮助公安机关完善适用监视居住中的不足,从而增强监视居住制度的可操作性。
The main purpose of the establishment of the supervision of residence system is to implement the concept of the presumption of innocence,reduce the application of custodial coercive measures,and limit the personal freedom of suspect through the supervision of public security organization,so as to ensure the smooth progress of criminal proceedings.However,due to its vague provisions,human rights violations often occur in the actual implementation process.By introducing the concept of strict law enforcement,focusing on establishing and improving legal rules,practicing legal standards,and strictly regulating the operation of law enforcement power,targeted solutions are further proposed to help the public security organization improve the shortcomings in the application of residential surveillance,thereby enhancing the operability of the supervision of residence system.
