摘要
培育法治思维是公安执法实训教学的关键性内容,其培养效果也在一定程度上决定着公安执法实训教学质量的高低。作为理论讲授与实训操作相结合的教学模式,公安执法实训教学应当以有效提升学员的法治思维能力为导向。在公安执法实训教学中,存在着理论讲授偏离于动态执法实践和实训操作忽视法治理论指引的两类误区。为了培育学员的法治思维,公安执法实训教学的理论讲授应当架构以提升法治思维能力为导向的法治理论体系,注重法规范的情境化具体阐释,形成研究型的实训教学模式;而面向法治思维培育的实训操作,应当注重真实案例的应用和模拟情境的仿真再现,建立科学的考核标准和组织分层次的实训教学,并在实训后进行深度的总结与提升。
Cultivating legal thinking is a key content of public security law enforcement practical training teaching,and its cultivation effect also to some extent determines the quality of public security law enforcement practical training teaching.As a teaching model that combines theoretical teaching with practical training,public security law enforcement practical training should be guided by effectively enhancing the legal thinking ability of students.In the practical training of public security law enforcement,there are two types of misconceptions:theoretical tea ching deviating from dynamic law enforcement practice and practical training operations neglecting the guidance of legal theory.In order to cultivate the rule of law thinking of students,the theoretical teaching of public security law enforcement practical training should be structured as a rule of law theoretical system guided by improving the ability of rule of law thinking,emphasizing the contextualized and specific interpretation of legal norms,and forming a research-oriented practical teaching mode;For practical training operations aimed at cultivating rule of law thinking,attention should be paid to the application of real cases and the simulation and reproduction of simulated situations,the establishment of scientific assessment standards and the organization of hierarchical practical teaching,and in-depth summary and improvement after practical training.
