摘要
在预付费交易形态中,消费者权利受到侵害后普遍利用《消费者权益保护法》第五十三条之规定进行事后救济。但是在与经营者订立合同时,由于消费者处于精神和信息上的弱势地位,导致其意思形成不自由,理应赋予其无理由退货权,使消费者得以谨慎判断形成真实意思。我国现行立法中只有《江苏省消费者权益保护条例》对预付费交易模式下消费者享有无理由退货权进行了明文规定,并在“江苏省预付卡退费第一案”中勇于适法。本文旨在探讨预付式消费形态中无理由退货权存续的正当性,通过对我国现行立法关于单用途预付卡的规制分析,运用解释论将无理由退货权的适用范围扩大至预付式消费中,并厘定该项权利的概念及性质,最后为预付式消费中无理由退货制度设计提供可行性建议。
In the form of prepaid transactions,after the violation of consumer rights,the provisions of Article 53 of the Consumer Protection Law are generally used for ex post relief.However,in contracting with the operator,because the consumer’s being in a weak position in spirits and information,resulting in that the formation of his meaning is not free,it should be given the right to return for no reason,so that consumers can form a real meaning.In the current legislation in the China's Mainland,only the“Regulations on the Protection of Consumer Rights and Interests in Jiangsu Province”clearly stipulates that consumers have the right to return for no reason in the prepaid transaction mode(Article 28),and it was applied to the“First Case of Jiangsu Province Prepaid Card Reimbursement”.The purpose of this paper is to explore the legitimacy of the right to return for no reason in the prepaid consumption pattern.Through the analysis of the regulation of single-use prepaid cards in China’s current legislation,I will use the interpretation theory to extend the scope of application of unreasonable right of return to prepaid consumption,determine the concept and nature of the right,and finally provide feasible advice for the design of unreasonable return system in prepaid consumption.
