摘要
互联网平台企业的屏蔽行为是近来多发的一类新型网络竞争行为,对于屏蔽行为是否具有合法性,我们不能仅凭自身朴素的正义情感或是对法条的粗浅认识,轻易定性。通常,屏蔽行为由《反不正当竞争法》规制为宜,但目前,该法尚无现成的制度资源评价屏蔽行为的合法性,与之相关的互联网专门条款与一般条款需要经过“法解释学”的科学、合理解释,方可适用。但市场支配型平台企业实施屏蔽的现象使《反垄断法》的介入成为可能。“微信屏蔽飞书”是一起典型的由市场支配型企业发起的竞争冲突事件,此类屏蔽事件是否构成“滥用市场支配地位”尚无定论,然其对于其他经营者、消费者、竞争秩序及创新效率皆有负面影响。有关执法部门应及早出台关于“屏蔽行为界定、规制”的竞争政策,以促进网络市场效率、维护竞争秩序。
The“shielding”of Internet platform enterprises is a new type of Internet competitive behavior which is frequently seen recently.However,we cannot easily determine the legality or illegality of the blocking,based on our simple judicial emotion or our shallow understanding of the law.In general,we’d better regulate the shielding behavior by“anti-unfair competition law”,but at present,this law has no available institutional resources to evaluate the legality of the shielding behavior,relevant Internet special terms and general terms can only be applied to after scientific and reasonable explanation of“hermeneutics of law”.The dominant platform enterprise’s implementation of shielding causes the intervention of anti-monopoly law.“WeChat blocks Feishu”is a typical competition conflict event which was initiated by market-oriented enterprises.Whether blocking event can be regarded as“abuse of market dominant position”or not,the courts haven’t decided yet,but it has a negative impact on other operators,consumers,competition order and innovation efficiency.Relevant enforcement departments should as soon as possible enact the definition,regulating“shielding”competition policy,in order to promote the network efficiency,maintain market competition order.
