摘要
AI技术、移动互联网、大数据、新信息通讯技术的更迭,推动着我国经济社会发展迈入"智能+"新时代,对现代文化市场体系提出了新发展诉求。从我国文化市场体系及其制度建设过程回溯与自检来看,存在三大"不匹配"问题,即智能时代新业态新模式层出不穷与传统文化市场管理方式不匹配,文化产品高度数字化网络化与文化版权市场保护制度不匹配,文化市场政策相对滞后性与新技术高速演进态势不匹配;从世界发达国家现代文化市场体系的制度建设参照来看,聚焦"调整版权保护水平""鼓励区块链发展""注重数字化运用"等政策与立法并举措施。鉴于此,在"智能+"时代,加快功能性政策、伦理政策、监管政策、知识产权政策等制度创新进程,将制度优势转化为发展效能,是新时期驱动现代文化市场体系不断健全的关键。
The changes of AI technology,mobile Internet,big data and new information and communication technology have pushed China’s economic and social development into a new era of"intelligence+",and put forward new demands for the development of modern cultural market system.From the retrospect and self-examination of China’s cultural market system and its system construction process,there are three major"mismatch"problems,including the emerging of new business forms and new models in the intelligent era,the mismatch with the traditional cultural market management,the mismatch between the highly digitized and networked cultural products and the cultural copyright market protection system,and the mismatch between the relative lag of cultural market policies and the rapid evolution of new technologies.From the perspective of the construction of modern cultural market system in developed countries,the era of"intelligence+"focuses on the policy and legislative measures such as"adjusting copyright protection","encouraging the development of blockchain"and"focusing on digital application".In view of this,accelerating the process of governance system innovation,including functional policy innovation,ethical policy innovation,regulatory policy innovation,intellectual property policy innovation,and transforming institutional advantages into governance efficiency,is the key to drive and enhance the governance ability of modern cultural market system in the new era.
