摘要
“一带一路”沿线中东欧国家,在历史、政治、经济、文化、法制等因素作用下,形成独特的音乐产权制度生态。基于此区域生态,中东欧二十国呈现西方文明圈、东正教文化圈、俄罗斯文明圈、混合文明圈四大区域音乐产权特性。中东欧国家多属于大陆法系,其国内音乐产权规范体系由基本法律与实施规范组成,国际条约和宗教教义也是其重要构成。中东欧音乐产权基本制度在各国的宪法、民法典、著作权法、刑法等中都有规定,但四大区域的具体制度不完全一致。四大区域音乐产权专项规范,涵盖主体类型、产权对象、权利内容,但各国具体规范状况差异较大;产权人的精神类产权与经济类产权保护相对充分,但综合类产权保护不足;刑事司法与海关行政保护受到注重,但民间救济措施不够完备。
Central and Eastern European countries along"The Belt and Road"have formed a unique ecosystem of music property rights under influence of historical,political,economic,cultural,legal and other factors.Under this kind of ecology,twenty countries of Central and Eastern Europe present four major regional music property characteristics:Western civilization circle,Orthodox cultural circle,Russian civilization circle and mixed civilization circle.Central and Eastern European countries mostly belong to civil law system,and their domestic music property right norm systems are composed of basic laws and implementation norms.International treaties and religious doctrines are also important components.The basic system of music property rights in Central and Eastern Europe is stipulated in basic laws of various countries,such as the constitution,civil code,copyright law,and criminal law,but specific systems in the four major regions are not completely consistent.The types,objects,and content of music property rights stipulated in the four regional special regulations vary greatly from country to country.Protection of spiritual and economic rights of property owners is relatively sufficient,but comprehensive property right’s protection is insufficient.Music property rights in the four major regions all focus on criminal justice and customs administrative protection,and the civil remedies are incomplete.
