摘要
舆情公案之所以引发全社会的广泛关注,是因为其作为一种特殊个案,对诸多社会问题具有吸附力,使各个阶层都可借以发挥自身作用。舆情公案的民粹主义叙事采用一种非常具有普遍性的文学叙事手法:首先,以己度人产生情绪共振;其次,在情绪的带动下实施对案件的"常识审判";最后,以相对偏激的话语在政治层面"带节奏"。民粹主义塑造阶级对立加剧社会撕裂,崇尚暴力导致社会生活西西里化,依赖道德狂热违背司法伦理,是对法治秩序的损毁。不能让舆情公案去负荷与自身没有直接关联的政治社会问题,应该就问题谈问题,探讨本身则必须接受法治的规训,即倡导理性、尊重法律以及坚持依法裁判。在司法职业主义的框架下,司法必须与民意适当保持距离。冷静、克制、理性以及专业的司法职业主义是当下认识和处理舆情公案的逻辑起点。
The reason why cases of public concern are enormously appealing to the whole society is that they are concentrated expression of the concerns of all classes.In the populist narrative,cases of public concern are first told to be touching;and then,a trial is giving by common sense;in the end,the public are imbued with an extreme political tendency.Populism triggers class-opposition and intensifies social disruption.It praises violence and moral fanaticism,while defies judicial morality and legal order.Cases of public concern are cases the same as the ordinary ones,and should not be connected with political and social issues.All cases,including cases of public concern,should be handled according to law without exception.Faced with cases of public concern,the judiciary should stay calm,restrained and rational,and keep a proper distance from the public.
