摘要
在民法典业已开启的法典化时代推进刑事诉讼法再修改,法典化问题自然备受关注。然而,法典化还是再法典化的争论并非关键问题,更为重要的是修法路径和具体内容。整合“法外规范”,适当增加法条文数量,既是趋势使然,也是完成修法任务的重要路径。按照推进以审判为中心的刑事诉讼制度改革的要求,本次修法应当将确立以审判为中心作为目标。构建“对人之诉”和“对物之诉”的双层诉讼目标,进一步强化涉案财物处置,是产权保护的必然要求。在轻罪时代,尤需合理配置刑事诉讼资源,在简案快审的同时着力推进疑案精审。基于立法应当回应司法实践的要求,本次修法应当全流程检视刑事诉讼程序的具体实务问题,进一步完善相关制度设计和运行措施,为推进刑事程序法治现代化奠定坚实的立法基础。
In the era of codification,which has already begun with the Civil Code,the issue of codification has naturally attracted much attention as the Criminal Procedure Law is being revised.However,the debate of codification or re-codification is not the key issue;what is more important is the path and specific content of the revision.The integration of“extra-legal norms”and the appropriate increase in the number of legal provisions are not only the trend,but also an important path to accomplish the task of amending the law.In accordance with the task of promoting trial-centered reform of the criminal procedure system.This amendment should establish trial-centeredness as the goal.Constructing a two-tier litigation goal of“actions in personam”and“actions in rem”,and further strengthening the disposal of property involved in the case,is the inevitable requirement of property rights protection.In the era of misdemeanors,it is particularly necessary to rationally allocate criminal procedure resources,and to promote the trial of suspected cases while focusing on the rapid trial of simple cases.Based on the requirement that legislation serves justice,this amendment should review the specific practical problems of criminal procedure in the whole process,further improve the relevant system design and operational measures,and lay a solid legislative foundation for the modernization of the rule of law in criminal procedure.
