摘要
中国和日本在立宪初期,行政与立法系统之间都产生了严重矛盾。运用一个至高无上的权威调解二者矛盾,避免双方破裂,这是一国立宪成功与否的关键。在近代中国和日本,这个权威就是皇权。日本在立宪初期运用天皇权威,成功调解了上述矛盾,维持了立宪体制。而中国皇权却难以发挥调解作用,反在连锁反应中土崩瓦解。两国有此差异的一个重要原因,就是两国皇权的权威不同。日本皇权具有神圣性,中国皇权则缺少神圣性。
In the early stage of constitutionalism,there were serious contradictions between administrative systems and legislative systems both in China and Japan.It was the key to a country's constitutional success that whether a supreme authority could be used to mediate their contradictions and avoid their ruptures.In modern China and Japan,these authorities were imperial powers.Japanese imperial power successfully mediated the contradictions and maintained the constitutional system.Chinese imperial power,by contrast,failed to mediate and collapsed in a series of chain reactions.The gap between the authorities of the two countries'imperial powers could be used to explain these differences discussed above.Japanese imperial power had sacredness,while Chinese imperial power lacked sacredness.
