摘要
基于遏制未成年人犯罪的低龄化发展趋势、安抚被害人及其亲属、更好地教育改造涉罪未成年人等原因,有必要对未成年人刑事责任年龄的下限进行调整。结合对未成年人自身发展程度、其他国家和地区相关制度的启示以及中国实际国情的考量,建议将刑事责任年龄下限降至13周岁。由于当前社会对未成年人犯罪的态度不一,降低刑事责任年龄的配套制度尚欠完善,在调整刑事责任年龄下限的同时应完善非刑罚处罚措施,充分发挥社区矫正制度功能,加快消除前科制度建设,实现未成年人权益保障和惩戒犯罪的和谐统一。
Building on curbing the trend of low-age juvenile delinquency,comforting the victims and their relatives,and better educating adolescents,it is necessary for us to adjust the lower limit of the age of criminal responsibility of adolescents.Considering the development of adolescents,the inspirations from other countries and regions’relevant policies,and the actual situation of China,it is recommended to lower the age of criminal responsibility to 13 years old.Thanks to people’s different attitudes towards juvenile delinquency and the deficient supporting system for lowering the age of criminal responsibility,it is advisable for us,before adjusting the lower limit of criminal responsibility,to improve the non-penalty punishment measures,givefull play tothe function of community correction system,and accelerate the elimination of the criminal record system,so as to achiev the harmonious integration of the rights and interests of adolescents and punishment.
