摘要
Bosca诉立陶宛仲裁案是意大利投资者Bosca先生援引《意大利-立陶宛双边投资条约》向海牙常设仲裁法院提起的国际投资仲裁案件。该案仲裁庭于2013年作出裁决,认定对本案具有管辖权,且被申请人违反了公平与公正待遇义务,但并未支持申请人的赔偿请求,认为申请人仅有权追回直接损失,即在投标过程中支付的费用以及本案的仲裁费用。由于被申请人之前已经向申请人偿还了投标款项,故只需从本案的案件保证金中扣除相应的仲裁费用。本文在梳理案件事实的基础上,分析了案件涉及的主要法律争议,即仲裁庭是否具有管辖权以及被申请人是否违反了公平与公正待遇条款等。同时,本文针对管辖权异议、投资者的合理期望和司法节制等问题进行了评析。
Bosca v.Lithuania is an investment arbitration case brought before the Permanent Court of Arbitration(PCA)by an Italian investor,Mr.Luigiterzo Bosca,invoking the Italy-Lithuania BIT.The award was rendered in 2013 and the Tribunal ruled that it had jurisdiction over the case,finding that the Respondent had breached the obligation of fair and equitable treatment,but did not uphold the Claimant's claim for damages,holding that the Claimant was only entitled to recover direct damages,i.e.,the fees paid in the bidding process as well as the costs incurred in this case.As the Respondent had already reimbursed the Claimant for the tender payments,only the corresponding arbitration costs were to be deducted from the case deposit in this case.On the basis of sorting out the facts of the case,this paper analyses the main legal disputes of the case,i.e.whether the Tribunal has jurisdiction and whether the Respondent has violated the fair and equitable treatment clause.Finally,the paper comments on the jurisdictional objections,investor’s legitimate expectations and judicial economy issues involved in the case.
