摘要
为切实保护儿童个人信息权益,网络平台依照现有法规完善其儿童个人信息保护政策有其必要性。本文在梳理《儿童个人信息网络保护规定》内容框架的基础之上,从网络运营者职责、使用许可规定、儿童信息生命周期相关规定、管理与保护儿童信息机制四个方面对当前30个网络平台所设的针对儿童个人信息保护的政策文本内容进行了调查与分析。目前,网络平台已在其政策中阐明了多种措施来加强儿童的个人信息保护,但在儿童群体专门性、基于儿童个人信息生命周期的政策全面性、政策对现实情境的考虑三个方面还存在难点。社会各层面应意识到儿童个人信息保护政策的多面性价值,直面儿童个人信息保护制度规范的现实困境,多方一体构建和完善儿童个人信息保护政策体系。
In order to effectively protect the rights of children’s personal information,it is necessary for internet platforms to improve policies according to the existing laws and regulations.Based on the content framework of Regulation on the Protection of Children’s Personal Information Online,policy texts on protecting children’s personal information set up by 30 internet platforms are studied and analyzed in the following aspects:responsibility of network operators,regulations of using permission,relevant regulations of children’s information life cycle,and children’s information management and protection mechanism.At present,network platforms have elaborated a variety of measures in policies to enhance the protection of children’s personal information,while problems still remain in specialization of children group,policy comprehensiveness based on children’s information life cycle,and consideration of reality.All levels of society should be aware of the value of children’s personal information protection policy,and policies for protecting children’s personal information should be established and improved to solve the realistic troubles.
