摘要
我国行政诉讼调解在理念上与德国行政诉讼中法官调解不谋而合,旨在解决纷争、消弭冲突。立法在适用范围的程序设计上试图参考德国与我国台湾地区诉讼和解的运行轨迹,但混淆裁量权与处分权,误认为行政机关具备裁量权即对诉讼标的具有处分权。这导致划定的适用范围具有"无限性",与行政诉讼有限调解之制度定位背道而驰,存在诸多弊端与风险。当"有限调解"的制度定位对应于"无限适用"的调解范围之时,行政权将处于司法监督真空。为实现行政诉讼有限调解之确立初衷,有必要重新厘定行政诉讼调解的适用范围。
The administrative litigation mediation in China coincides with the court mediation in Germany’s administrative proceedings in perspectives,which aims to resolve disputes and eliminate conflicts.Legislation attempts to refer to the trajectory of litigation reconciliation in Germany and Chinese Taiwan in the design of the application scope of the program,but confuses the power of discretion and the power of disposition,and mistakenly believes that the administrative organ has the discretionary power that is the power to dispose the object of action.It leads to the"unlimited"application scope,which runs counter to the institutional positioning of limited mediation in administrative litigation,raising many drawbacks and risks.When the institutional positioning of"limited mediation"corresponds to the"unlimited"application scope,administrative power will be in a vacuum of judicial supervision.In order to imply the original intention of the limited administrative litigation mediation,it is necessary to re-determine the application scope of administrative litigation mediation.
