摘要
教育领域争议因争议的主体、原因与法律适用的不同,分为教育领域民事争议、行政争议和刑事争议三类,不同类型的争议具有不同的性质与救济机制。本文从教育领域争议的类型与性质出发分析中国教育领域争议救济机制的现状,以问题为导向发现其不足并提出完善建议,为构建行之有效的争议救济方式提供思路。
Disputes in the education field are divided into three categories:civil disputes,administrative disputes,and criminal disputes due to differences in the subject,cause,and application of the law.Different types of disputes have different natures and relief mechanisms.Starting from the type and nature of disputes in the education field,this paper analyzes the current situation of Chinese education dispute relief mechanism,finds its shortcomings based on the problem and puts forward suggestions for improvement,and provides ideas for constructing effective dispute relief methods.
