摘要
"醉驾入刑"以后,我国相关规定明确将量化判断模式作为醉酒状态的唯一证明路径。当前,有关量化判断模式证据规则的规定较为简单,有必要结合及时性及全面性的要求完善量化判断模式下的取证规则,并进一步丰富量化判断模式的认证规则。量化判断模式对驾驶者醉酒状态的认定依赖于驾驶者血液酒精含量的精确数值,因此,在无法取得驾驶者的血液酒精含量以及驾驶者血液酒精含量超标幅度不大的情况下,量化判断模式恐怕无法帮助司法人员准确认定案件事实,在这些特殊情况下,可以引入驾驶能力判断模式认定驾驶者的醉酒状态。由此,可以构建"以量化判断模式为主,驾驶能力判断模式为辅"的醉酒状态二元证明路径。
Since driving while intoxicated became a crime in 2011, the supreme judicial interpretation announces the quantitative evaluation mode as the only way to prove intoxication. But the existing evidence rules regarding the quantitative evaluation mode are too simple. To make the quantitative evaluation mode more effective, it is necessary to enrich the rules of evidence collection and the rules of authentication under the governance of timeliness principle and comprehensiveness principle. In fact, the quantitative evaluation mode,which relies on the precise number of the blood alcohol concentration(BAC) to determine intoxication, could fail in helping judiciary make correct factfinding, when the law enforcement is unable to obtain the driver’s BAC or when the deriver’s BAC is modestly over the legal limit. In such situation, the driving capacity evaluation mode can be introduced to prove intoxication. Thus, a binary proof mode, which is dominated by quantitative evaluation mode and supplemented by driving capacity evaluation mode, can be established in the proof of intoxication.
