摘要
加密货币、NFT等元宇宙数字资产成为元宇宙经济系统的血液,在推动经济和产业的大爆炸、大发展的同时也带来了数字资产类新型犯罪等风险。当前理论上对于元宇宙数字资产的刑法属性界定存在“数据说”和“财物说”的争议,司法实务中也存在混淆传统网络虚拟财产与元宇宙数字资产本质特征、对元宇宙数字资产财物属性认定不一等情形,从而引发同案不同判、财产性损失难以评估等现实问题。对元宇宙数字资产刑法属性的界定应跳出传统计算机犯罪单一评价体系,结合其所具有的稀缺性、独占性和排他性等特征,将元宇宙数字资产解释为刑法上的财物,并遵循数字经济规律,运用“平台-数据-算法”分析范式对以数字资产为核心的数字犯罪的构成要件进行分析,形成基于“法链”原理的“以链治链”司法体系架构,防范新型数字金融犯罪风险,营造数字犯罪预防与治理的良好司法环境,最后实现对元宇宙数字资产刑法规制范式的重构。
Crypto currency,NFT and other metaverse crypto assets have been the blood of metaverse economic system.While promoting the explosion and development of economy and industry,they also bring risks such as new types of crimes related to crypto assets.At present,there is a dispute about data theory and property theory on the definition of the criminal law attribute of metaverse crypto assets.In judicial practice,there is a confusion between the attribute characteristics of traditional network virtual assets and metaverse crypto assets,which leads to different judgments in the same case,and it is difficult to assess property losses and other practical problems.The definition of the criminal law attribute of metaverse crypto assets should jump out of the traditional single evaluation system of computer crimes,interpret it as property in criminal law,use the P-D-A Paradigm:threedimensional structure to analyze the constituent elements of digital crimes.We should form a judicial system framework based on the principle of RegChain and JudiChain,preventing the risk of new digital financial crimes,creating a pretty judicial environment for the prevention and governance of digital crimes,and finally realizing the reconstruction of the criminal regulation paradigm of digital assets in metaverse.
