附条件逮捕制度是近年检察机关出台的一项审查逮捕改革措施,其核心是将原本不符合逮捕条件的犯罪嫌疑人批准逮捕。该制度违反《刑事诉讼法》第60条之规定,违背程序法定和刑事司法解释的原则,背离刑事诉讼的价值目标,不符合司法改革的基... 附条件逮捕制度是近年检察机关出台的一项审查逮捕改革措施,其核心是将原本不符合逮捕条件的犯罪嫌疑人批准逮捕。该制度违反《刑事诉讼法》第60条之规定,违背程序法定和刑事司法解释的原则,背离刑事诉讼的价值目标,不符合司法改革的基本原则。该制度难以避免逮捕适用的扩大化和超期羁押现象。从实施情况看,存在着任意扩大适用范围、撤捕比例高、违背程序现象严重、不利于提高公安机关的办案质量等弊端。实施附条件逮捕制度只会扩张检察机关的逮捕权,而不会利于保障犯罪嫌疑人的合法权益。建议立法机关对附条件逮捕制度进行审查,并通过相关程序修改或废止这一制度。 展开更多

This paper presents analytical studies carried out explicitly on a higher-dimensional generalized Zakharov–Kuznetsov equation with dual power-law nonlinearity arising in engineering and nonlinear science.We obtain analytic solutions for the underlying equation via Lie group approach as well as direct integration method.Moreover,we engage the extended Jacobi elliptic cosine and sine amplitude functions expansion technique to seek more exact travelling wave solutions of the equation for some particular cases.Consequently,we secure,singular and nonsingular(periodic)soliton solutions,cnoidal,snoidal as well as dnoidal wave solutions.Besides,we depict the dynamics of the solutions using suitable graphs.The application of obtained results in various fields of sciences and engineering are presented.In conclusion,we construct conserved currents of the aforementioned equation via Noether’s theorem(with Helmholtz criteria)and standard multiplier technique through the homotopy formula. 展开更多

In order to evaluate the effects of structural control and energy transition for the base-isolation with energy transducer (BIET), shaking table tests on a steel frame model (BIET system) with scale of 1:4 were conducted and the results were compared with the lead rubber beating (LRB) isolation system for the same model. Then numerical analysis of the system was carried out, in which the improved Wen analytic model was used to simulate the hysteretic law of transducers. The results show that the structural system can transform the partial earthquake energy to hydraulic energy ; furthermore, the effect of structural control can reach or be close to that of the LRB isolation system. The agreements between numerical analysis results and those of shaking table tests demonstrate the accuracy of the numerical model. 展开更多

With the aid of an obtained conservation law, the generalized double reduction theorem is applied to this equation. It can be shown that the reduced equation is a second order nonlinear ODE. The effect of the solid matrix and porosity of the porous medium are first introduced to the study of power-law nanofluids, and the Marangoni boundary layer flow with heat generation is investigated. Two cases of solid matrix of porous medium including glass balls and aluminum foam are considered. The governing partial differential equations are simplified by dimensionless variables and similarity transformations, and are solved numerically by using a shooting method with the fourth-fifth-order Runge-Kutta integration technique. It is indicated that the increase of the porosity leads to the enhancement of heat transfer in the surface of the Marangoni boundary layer flow. 展开更多
