摘要
二次创作是随着网络技术发展起来的一种独特创作形式。二次创作作品独创性标准模糊、未取得原创作品作者授权是二次创作面临的版权问题困境。版权意识薄弱、合理使用制度发展滞后以及平台监管责任落空是导致二次创作版权问题产生的原因。为解决上述问题,可以考虑从加强版权意识宣传、以对著作权法扩大解释的途径完善合理使用制度以及强化网络服务平台监管法律责任三个方面切入,探讨解决措施。
Secondary creation is a unique creation form with the development of network technology. The difficulty of copyright in secondary creations is that the originality standard is vague and the au-thorship of the original works is not obtained. Weak copyright awareness, the development of fair use system and the failure of platform supervision are the reasons that lead to the secondary crea-tion of copyright problems. In order to solve the above problems, we should consider strengthening the publicity of copyright awareness, perfecting the reasonable use system by expanding the interpretation of copyright law and strengthening the legal responsibility of the supervision of network service platform.
