摘要
在全球化和互联网技术的推动下,跨境电商已成为国际贸易的重要组成部分。然而,伴随其快速发展的是一系列法律冲突问题,包括合同法律冲突、知识产权法律冲突、消费者权益保护法律冲突、税收法律冲突以及数据隐私法律冲突等。这些冲突主要源于不同国家和地区法律制度的差异、国际贸易规则的不完善以及互联网的跨国界性质。为了应对这些法律冲突,现有的解决机制包括国际公约与条约的制定、国内法的适用与协调、跨境电商平台的自律机制以及仲裁与诉讼的解决途径。然而,这些机制在实践中仍面临诸多挑战。因此,本文提出加强国际合作与协商、推动制定统一的国际规则、建立跨境电商纠纷解决机构以及加强法律培训与宣传等建议,以期完善跨境电商法律冲突解决机制,促进跨境电商的健康发展。
With globalisation and the rapid development of e-commerce, cross-border e-commerce has become an important force in connecting national markets and promoting the growth of international trade. However, cross-border e-commerce faces complex conflict of law issues in the process of development, which not only affect the smooth running of transactions, but also may bring serious challenges to the protection of consumer rights and interests, intellectual property rights protection, tax collection and management, and data privacy security. This paper firstly classifies and analyzes the common legal conflicts in cross-border e-commerce, including contractual legal conflicts, intellectual property legal conflicts, consumer protection legal conflicts, tax legal conflicts and data privacy legal conflicts. These conflicts often stem from the differences in the legal systems of different countries and regions, the imperfection of international trade rules and the cross-border nature of the Internet. This is followed by an in-depth discussion of the existing mechanisms for resolving cross-border e-commerce conflict of laws. These mechanisms include the formulation and implementation of international conventions and treaties, the application and coordination of domestic laws, the self-regulatory mechanism of cross-border e-commerce platforms, and legal remedies such as arbitration and litigation. To a certain extent, these mechanisms provide a legal framework and path for the resolution of cross-border e-commerce disputes. However, the existing mechanisms still face many challenges and deficiencies in practice. Therefore, this paper further puts forward recommendations to improve the cross-border e-commerce conflict of law resolution mechanism. These suggestions include strengthening international cooperation and consultation to promote the development of more uniform and improved international rules;establishing a specialised cross-border e-commerce dispute resolution agency to improve the professionalism and efficiency of
