摘要
我国商标法历经五次修改,愈发重视商标的使用,但并未有针对服务商标的具体条款,忽视服务商标的地域性特征。司法实践中,对服务商标地域性的考量存在不同做法,法官自由裁量权较大,裁判结果不一,均未重视商标的实际使用。服务商标的地域性是商标实际使用情况的反映,影响混淆可能性的判断,在服务商标侵权判断中考虑具有正当性。在重视商标使用的前提下,服务商标地域性的考量应结合服务商标所在行业特点、商标权人的使用方式和使用范围、适当考虑被告的使用方式综合判断。
Trademark Law has undergone five revisions, and more and more attention has been paid to the use of trademarks, but there are no specific provisions for service marks, ignoring the regional characteristics of service marks. In judicial practice, there are different approaches to the consideration of the territoriality of service trademarks, with judges having greater discretion and different adjudication results, all of which do not attach importance to the actual use of trademarks. The territoriality of a service mark is a reflection of the actual use of the trademark, which affects the judgment of the likelihood of confusion, and is considered legitimate in the judgment of service mark infringement. On the premise of attaching importance to the use of the trademark, the consideration of the territoriality of the service mark should be comprehensively judged in combination with the characteristics of the industry in which the service mark is located, the trademark owner’s mode of use and scope of use, and the defendant’s use mode with due consideration.
