网络环境下滥用市场支配地位行为的认定有其特殊性。判定一个经营主体是否有滥用市场支配地位行为,应当在正确界定“相关市场”的前提下,判断该经营者在该“相关市场”内是否具有“市场支配地位”,并分析其是否有滥用该市场支配地位的行为。本文就以奇虎360与腾讯QQ的反垄断案为例,分析“二选一”的行为性质,发现现有法律规制中的失灵问题,揭露电商平台“二选一”行为在法律规制中出现的漏洞、在适用中还需完善的地方,并提出了相应的解决措施和新途径。
The identification of abuse ofdominant market position in the network environment has its particularity. Todetermine whether an operating entity has abused its dominant market position,it should be based on the correct definition of “relevant market”. Judgewhether the operator has a “dominant market position” in the “relevant market”,and analyze whether it abuses the dominant market position. Taking theanti-monopoly case between Qihoo 360 and Tencent QQ as an example, this paperanalyzes the nature of the “choose one” behavior, finds the failure problems inthe existing legal regulations, exposes the loopholes in the legal regulationsof the “choose one” behavior of e-commerce platforms, and places that need tobe improved in the application, and proposes corresponding solutions and newapproaches.
