摘要
现代科技迅猛发展,人工智能领域也在不断进行着革新与突破。尤其在文学、艺术和科学领域,部分人工智能生成物同人们的创意作品在外观上已经无法区别,从而带来了全新的法律挑战:人工智能能否成为创作的主体?人工智能生成物可否归属为同人类创作物一样受到著作权法保护的作品?这些问题成为了当前法学界争议的焦点。同时,实践中人工智能领域的社会矛盾与纠纷也在频频发生,以此些问题为基础的人工智能生成物的法律保护模式也亟待完善。日本对此问题关注较早,近年来也开始商议修订知识产权法或通过反不正当竞争法与类似商标注册的方式来起到保护人工智能生成物的作用。本文将通过探讨日本对人工智能生成物的法律保护模式的可行性,与此同时思考与展望我国人工智能领域的法律保护路径,以促进中国人工智能产业健康、稳定的发展,持续提高产业活力与竞争力。
With the rapid development of modern science and technology, the field of artificial intelligence is constantly innovating and making breakthroughs. Especially in the fields of literature, art and science, some AI-generated works are no longer distinguishable from human creations, raising a new legal challenge: Can AI be a creative agent? Can AI-generated content be classified as works under the same protection of copyright law as human creations? These problems have become the focus of controversy in the current legal field. At the same time, social contradictions and disputes in the field of artificial intelligence also occur frequently in practice, and the legal protection mode of the AI-generated work based on these problems also needs to be improved. Japan is an early concern, Japan held preliminary discussions on the creation of artificial intelligence. In recent years, Japan also began to discuss the revision of intellectual property law or the anti-unfair competition law and similar trademark registration to protect the products of artificial intelligence. This paper will discuss the feasibility of Japan’s legal protection mode for the AI-generated work, and at the same time think and look forward to the legal protection path in the field of artificial intelligence in China, so as to promote the healthy and stable development of China’s artificial intelligence industry, and continuously improve the vitality and competitiveness of the industry.
