摘要
党的十八届三中全会为实现全面深化改革的总目标提出了一个全新的概念——国家治理体系和治理能力现代化,这对我国的政治、经济、社会等多方面有关键意义,构建中国特色社会主义法治体系、全面深化司法体制改革、落实司法责任制是重要的法治保障,本文尝试以设立责任清单制度、完善分案机制来解决人民法院在推进司法责任制改革过程中遇到的职责混同、责任边界模糊的瓶颈,为推进国家治理体系和治理能力现代化提供坚实的法治保障。
The Third Plenary Session of the 18th CPC Central Committee put forward a new concept—the modernization of national governance system and governance capacity, which is of key significance to China’s politics, economy and society. Building a socialist legal system with Chinese characteristics, comprehensively deepening the reform of the judicial system and implementing the judicial responsibility system are important legal guarantees. This paper attempts to establish a responsibility list system and improve the case division mechanism to solve the bottleneck of mixed responsibilities and fuzzy responsibility boundary encountered by the people’s court in promoting the reform of judicial responsibility system, so as to provide a solid legal guarantee for promoting the modernization of national governance system and governance capacity.
