摘要
夫妻财产约定制尽管在国外立法例中已有较完善的规定,但在我国仍是一片有待继续开垦的土地,特别是关于夫妻财 产约定的内容、程序、法律效力及对夫妻财产约定的法律限制等问题,现行婚姻法都未有明确规定,理论上的探讨研究将有助于该项 制度在我国今后立法中得以充实完善。
Although the prescription of martial property system in foreign legislations is almost perfect, it's still a new -born baby in China, especially the prescription about the content, procedure, legal validity and legal restriction of the marital property system. The discussion of this system will be of great importance to its perfection.
