摘要
在《易经》的部分卜辞中 ,记载了商周时代的“自由刑”:一是圜土之刑 ,包括该刑在刑罚中的地位、执行处所、执行方式、防范罪犯逃脱的设施、刑期等内容 ;二是肉刑的附加刑 ;三是坐嘉石之刑。以上内容可与《周礼》的有关记载互为佐证 ,较为可信地反映出商周刑罚种类之一的“自由刑”
In some part of oracle inscription of Shang Dynasty in the Book of Change, The punishment to the freedom was recorded as follows. The first was the System of Prison(Yuan Tu). It included the position of this one in penalty, the place of implement, the way of implement, facilities to prevent criminals from escape and the date of punishment. The second was an additional form of punishment to the body. The third was the System of Surveillance(Zuo Jia Shi). All the contents above can be taken'The Rites of Zhou Dynasty'as evidences which reflected the historical evidences of Punishment to Freedom as one of penalties in Shang Dynasty and Zhou Dynasty.
