摘要
根据韩国民法的规定,证券借贷是一种消费借贷行为,当双方当事人接受(返还)证券和借出证券的种类与数量都相同时,证券借贷契约成立。
The Korean experience shows that the flourish of securities financing market is related to the demand arising from the strategic exchanges in a market with various investment products. With the development of China securities market, derivative products will inevitably arise such as index future, warrants, index futures and option. And this will in turn lead to a demand of strategic exchanges in the market and eventually margin trading and securities finance. The study of the Korean experience will provide us with some useful thoughts on the future development of China securities market.
