摘要
由于立法指导思想和原则的不明确 ,导致我国民事强制执行制度在制定和实际运行中存在着明显的缺陷。完善我国强制执行立法要做好四方面工作 :第一 ,建立一套完整的民事强制执行法律体系 ;第二 ,立法指导思想要立足于惩罚与教育相结合 ;第三 ,要加强人民法院的执行工作力度 ;第四 ,执行措施要跟上社会经济发展的需要 ,并有相应的程序辅助。
Due to ambiguity of legislative thought and principles, there is obvious imperfe ction in the founding and practical using of Chinas civil enforcement system. To perfect Chinas legislation in enforcement, works in four aspects are to be done: firstly, establishment of an overall civil enforcement legal system; secon dly, legislative thought being on the basis of combination of punishment and edu cation; thirdly, strengthening of enforcement work by peoples courts; and four thly, enforcement measures matching the need of social economic development with some relevant assist programs.
