摘要
在多边贸易体制中如何实现环境保护与贸易自由的协调发展,这是一个“国际贸易新问题”,GATT规则及其争端解决实践对此问题基本上持回避、谨慎的态度。随着新世纪“千年回合”的启动,多边贸易体制中的环境保护问题再次成为瞩目的热点。中国作为发展中国家该如何面对这一“国际贸易的新问题”,亟待研究和解决。本文将对多边贸易体制中有关环境保护的规则及争端解决机构对该问题的态度进行全面阐述,并对现行多边贸易体制中环境保护问题的发展趋势进行深入分析。
Under multilateral trade system, how to harmonize the relationship between environmental protection and trade liberalization is a new issue in international trade. GATT rules and its dispute settlement practices usually runaround the issue. With the establishment of WTO, multilateral trade system paid more attention to it. The practices of the appellate of WTO reflected a trend that the value balance of WTO inclines to environment. Doha ministerial conference and Cancun ministerial conference indicated multilateral trade system compromised with environmental issue. The evolutional trend of environmental protection in multilateral trade system will challenge trade security of developing countries.
