摘要
单位犯罪自首是贯彻刑法基本原则的必然要求,它符合我国设立自首制度的立法意旨,是承认单位犯罪的逻辑必然。成立单位犯罪自首,它除了具备普通自首的两要件外,还须具备两个前提条件———基于单位自首意志和以单位名义实施。处罚自首的犯罪单位时,要区分单位与自然人的刑事责任。
Self-accusation of unit offense is inexorable for carrying out criminal basic principles,according with the legislative intention of establishing self-accusation system in our country,and logical necessity to acknowledge unit offense.The requirements for self-accusation of unit offense,besides the two requirements for common self-accusation,must possess two prerequisites namely based on the unit’s will of self-accusation and in the name of the unit punishing the self-accusation of unit offense,must distinguish the responsibity of the unit’s from the personal while punish the self-accusation unit.
