摘要
解读和认定重婚罪,应当明确婚姻法的立法原则和价值取向。事实婚不受法律保护,法律婚是重婚的前提。只有法律婚才具有配偶权。法律婚与事实婚的重合,法律婚与法律婚的重合,都是对法律婚或者说配偶权的严重侵害,均可构成重婚罪。
