摘要
西方国家内部存在着促成“法治”的“基因”。其法治的生成是其政治权力多元与制衡的政治传统、法律至上的文化传统、源远流长的商品经济历史等社会、文化、经济原因逻辑演化的结果。通过对西方法治的生成路径的分析,并揭示法治的形成规律,将对其它正在进行法治建设的国家有所启示。
The western country is interior law-rulung country. Rule of law in die west results from three factors. The first is political tradition of the condition of controlling among plural political power; the second is cultural tradition of surpreme of law, the third is long history of merchanise economy. Analyzing the course or rule of law in the west and finding the gularity which forms rule of law are helpful to other countries which is constructing rule of law.
