摘要
本文从损害在侵权行为法上的地位出发 ,论述了侵权行为法范畴中损害的概念和特征 ,并对相关概念进行了比较。作者还对损害的性质进行了探讨 ,认为损害本质上是一种利益丧失状态。并且 ,作为侵权行为构成要件的损害和侵权赔偿中的损害在内涵上应该是一致的。
Beginning with the status of damage in the torts law ,the paper demonstrate the conception and characters of damage in the torts law. And compare it with concerned conceptions. The author makes research about the nature of damage and concludes that damage is a kind of state of interest losing .Therefore ,the intention of damage as one of part of tort action is consisted with that of the damage in the compensation of tort .The author considered that the tort law that will be laid down shoud take the conception of damage in .
