摘要
伴随着各国探寻监禁刑替代措施的历程 ,社区服务刑在国外异军突起 ,并有扩大适用的趋势 ,它与罚金和缓刑这两种传统的替代措施一道 ,在减少监禁刑适用方面发挥着异乎寻常的作用。我国目前尚未将社区服务刑引入刑罚体系中 ,因此 ,借鉴国外刑法中社区服务刑的合理内核 ,对进一步健全和完善我国的刑罚制度和罪犯处遇制度无疑是大有俾益的。
The appearance of community service punishment in some foreign countries plays a positive role on reducing the imprisonment.In our penalty system there is no community service punishment yet,therefore,it is meaningful to apply the rational parts of it and to draw on the experience from it.
