摘要
离婚损害赔偿责任是一种侵权责任,破坏婚姻关系行为是侵害配偶权的侵权行为。建立侵害配偶权精神损害赔偿制度是婚姻义务的内在要求;是配偶身份权之民法属性的直接反映;是完善婚姻家庭法、加强社会主义法制的必要内容。离婚损害赔偿具有三方面的功能:填补损害;精神慰抚;制裁、预防违法行为。离婚损害赔偿的构成须同时具备有法定违法行为、损害事实、因果关系和主观过错四个要件。离婚精神损害赔偿请求权的主体仅限于无过错配偶,承担损害赔偿的责任主体只能是实施法定违法行为并导致离婚的过错配偶。
The duty of damage compensation in divorce is a duty of infringement. The behavior of broken marital relationship is the infringement behavior violating the spouse right. The establishment of the spirit indemnity system violating the spouse right is the inside request of marital compulsony. And it is the direct reflection that the power of the spouse body belongs to the civil law. Also, it is the necessary contents of perfecting the marriage family law and strengthening the socialist legal system. There are three main functions of the damage compensation in divorce: fill up the damage,spirit appeases, and sanctions that prevent the behaviors of breaking the law. The composing beard of the divorce indemnity civil case duty must have four important items at the same time,those are the behavior of breaking the law, the injure fact,the relationship between cause and effect,and the subjective fault. The corpus of the divorce indemnity request is only for the no fault spouse,and the corpus of undertaking the damage compensation in divorce is only the fault spouse who has malpractice in legal and causes divorce.
