摘要
长沙五一广场出土东汉简牍内容丰富,存有大量司法文书,其中有许多涉及职务犯罪。据已公布的《长沙五一广场东汉简牍》【一】【二】辑所见,常见的职务犯罪名目有不履行职责的'不承用诏书、不敬、不当得为'、以权谋私的经济犯罪'主守盗、盗赋受所监、受赇请'、执法不公正的'匿、纵'罪人等。针对东汉形式多样、原因复杂的职务犯罪,当局亦有相应的措施进行较为严密的监督、严惩冒犯者,因而能够维护吏治及国家机器的正常运转。
The Bamboo Slips of the Eastern Han Dynasty unearthed from Changsha Wuyi Square are rich in content and contains a large number of judicial documents,many of which involve duty crimes.According to the published Eastern Han Bamboo Slips in Changsha Wuyi Square Ser.1 and Ser.2,the common forms of duty crime mainly include such crimes like failing to perform one’s duty,economic crime of abusing power for personal gains and unfair execution of law in terms of'hiding and conniving'.In response to the various forms of duty crimes in the Eastern Han Dynasty,the authorities also have corresponding measures to carry out strict supervision and severe punishment of offenders in order to successfully maintain official administration and normal operation of the government.
