摘要
最高人民法院《二五纲要》正式提出建立和完善案例指导制度。但许多学者忽视了案例指导制度和判例制度的本质差异。案例指导制度应当是基于中国审判制度现状,放置于整个审判指导制度改革的大背景中。国外的判例制度已经随着时代的发展有着巨大的变化,我们所着眼的应当是现有的和未来的而非史书上的判例制度。
The summary of the new reform of the Supreme Court Proposes that our country will establish the case guiding system. We often cannot realize the difference between"the case guiding system"and"the case system". The case guiding system should be set in the whole plan of reform about judgment. The foreign case system has been changed greatly. We should research the new system instead of the old one.
