一、引言最近,全球最爲關注的訴訟動向是,高通、蘋果終於達成全球和解,雙方於2019年4月17日同時在官網發佈聲明,宣佈雙方撤回在全球範圍内的所有訴訟。根據和解協議,蘋果將向高通支付一筆一次性款項。雙方還達成了一項爲期六年的專利直接授權許可協議,該協議已在2019年4月1日生效.
I. Introduction Apple and Qualcomm have been engaged in a legal cat-and-mouse game for a long time now, and eventually reached a settlement on a worldwide scale. They issued a statement on their respective official websites on 17 April, 2019, announcing that all litigation between the two companies worldwide had been dropped. The settlement agreement also included a one-time payment from App e to Qual-comm of an undisclosed amount. They had reached a six-year patent license agreement lhat has taken effect on 1 April, 2019, which includes a two-year extension option and a six-year chip set supply agreement. ' It was also reported that Qualcomm has announced the first quarter of fiscal 2019 results on 1 May, 2019 that it expects to record the one -time payment of S4.5 billion to $4.7 billion, which mainly come from its settlement with Apple, as speculated.2
