摘要
了解检察体制的基本逻辑和逻辑的转变,可以更好地理解和把握检察体制存在的问题、改革的空间和未来的走向。本文分析近期最高人民检察院带动的内设机构调整的法律监督根本职能这一逻辑起点,以及检察机关通过公益诉讼拓宽法律监督渠道的努力,指出"法律监督"是一个具有纵深性的、涵盖面很广的概念,人民检察院未来在国家和社会治理层面的作用得到重新认识,"法律监督"的范围还会有进一步拓宽的机会。另外,检察机关内设机构中原本存在组织法逻辑和诉讼法逻辑,在刑事检察领域是按刑事诉讼法逻辑建构内设机构的,当前的内设机构调整体现了以刑法逻辑取代刑事诉讼法逻辑,"捕诉一体"就是这种逻辑转变的结果。内设机构调整,有望为"捕诉一体"的学术争议划上一个句号,但是这一争议含有的刑事诉讼意义上的专业化问题仍然值得重视。
Everything has its inner logic. Understanding the basic logic of the procuratorate system and its conversion can help us better comprehend and get hold of the procuratorate system’s exsiting problems,reform space and future development. This article analyzes the adjustment of the inner organization led by the Supreme People’s Procuratorate,take the legal supervision function of the procuratorate as logical starting point,and focus on the hard work of broadening legal supervison means through public interest litigation done by the procuratorate. Through the above analysis,this article points out that 'legal supervision'is a concept with depth and breadth. The future function of the procuratorate on the governance of the nation and the society is re-recognized,and the content of'legal supervision'can be more broadened. Furthermore,the inner organization of the procuratorate used to be constructed under both the organization law logic and the procedure law logic. In the criminal procuratorate field,the inner organization was built under the criminal procedure law logic. Now,the adjustment of the inner organization shows that the criminal procedure law logic has been replaced by the criminal law logic. The 'integration of arrest and prosecution'is the result of such conversion.The adjustment of the inner organization may put a stop to the academic controversy of the 'integration of arrest and prosecution'. However,the problem of the professionalization of criminal procedure law,which is presented in the academic controversy,remains to be taken seriously.
