摘要
农村宅基地是农民的基本财产之一,事关农民的切身利益以及农村的经济发展和社会稳定。立法话语权是农民的一项基本权利,但是目前我国农民自身诉求表达受到阻碍,这使得农民在农村建设中的作用没有得到有效发挥。这是由于农民参与立法的能力不足、农民缺少参与途径、农民参与立法的程序不健全、立法机关的主导性过强。为了保护农民的权益,弥补立法机关的立法能力不足,需要赋予农民更多的话语权来表达他们的利益诉求,以此来实现立法精英化与大众化相结合,促进社会主义新农村建设以及和谐社会的构建。这就需要培养农民参与立法的能力、扩大农民参与立法的渠道、健全农民参与立法的程序。
Rural homestead is one of the basic properties of farmers,which is related to the vital interests of farmers and the economic development and social stability of rural areas.Legislative discourse right is a basic right of farmers,but at present,farmers in China are still in a disadvantaged position,and the expression of farmers’own demands is hindered,which makes the role of farmers in rural construction has not been effectively brought into play.This is due to the lack of capacity of farmers to participate in legislation,the lack of ways for farmers to participate in legislation,the imperfect procedures for farmers to participate in legislation,and the excessive dominance of the legislature.In order to protect the rights and interests of farmers and make up for the lack of legislative capacity of the legislature,it is necessary to give farmers more voice to express their interests and demands so as to realize the combination of legislative excellence and popularization and promote the construction of a new socialist countryside and the construction of a harmonious society.Therefore,it is necessary to cultivate the capacity of farmers to participate in legislation,expand the channels for farmers to participate in legislation,and improve the procedures for farmers to participate in legislation.
