摘要
物权法中的物权法定原则和公示原则,构成物权法实施后确认物权的两项基本原则,对于用物为银行贷款提供抵押或质押以防范银行金融风险,具有重大的指导意义。同时物权法在担保物权制度方面与现行的担保法相比较有一些值得注意的新变化,需要认真研究并依法予以改进。
The Property Statutory Principle and the Publicity Principle in the Property Law are the two basic principles in confirming the real rights.The principals have great guiding significance to prevent bank financial risks regarding mortgaging or impawning substance for bank loans.At the same time,the guarantee property right system in the ftoperty Law has some noteworthy changes compared with the existing Security Law,so careful research is needed to be improved in accordance with the Law.
