摘要
侦查构造指的是侦查程序中主体之间的相互关系。理论上分为三种学说:纠问式侦查观、弹劾式侦查观和诉讼式侦查观。我国的侦查观接近于纠问式侦查观。要完善我国的侦查构造,必须要构建一体化的侦查程序。其重点在于:构建一体化的检警格局,设立中立的司法机构,提高犯罪嫌疑人的诉讼地位,扩大辩护律师的参与范围并完善 侦查程序中的实施性规则。
Investigation structure refers to the relationship between parties involved in investigation.Academically,the structure falls into three trends:interrogation trend,impeachment tread and litigation tread. To perfect our investigation structure,it is a must to set up an integrated procedure for invesgation the focus of while lies in the following aspects:to set up an integrated arrangement for the procuratorates and the police,to establish a neutral judicial organization,to raise the suspect抯 litigation status,to deepen the particiption of the defense counsel and to perfect the enforcement regulations in investigation procedure.
