摘要
车务系统是国家铁路局保障铁路运输安全的关键监管对象。我国铁路实现'政企分离'后,原铁道部的车务安全监管制度体系已不适用于国家铁路局。通过对铁路总公司车务安全监管内容的梳理和分析,提出国家铁路局角度的车务安全监管内容。分析了政府车务安全监管法律法规和规章制度体系的现状以及总公司企业规章的体系现状,提出国家铁路局在车务安全监管方面存在的问题。通过以上分析再借鉴其他行业在制定规章上的经验提出了完善我国现有铁路车务安全监管制度的相关建议,构建了完整的制度体系,为国家铁路局对车务系统实现有效监管提供了相关参考。
The train operation system is the key supervisory object of the National Railway Administration to ensure the safety of railway transportation.After the realization of'separation of government and enterprise'in China’s railways,the train operation safety supervision system of the former Ministry of Railways has not been applied to the National Railway Administration of People’s Republic.Through sorting out and analyzing the contents of train operation safety supervision of the China Railway,the contents of train operation safety supervision from the perspective of the National Railway Administration were put forward.This paper analyses the current situation of laws,regulations and rules system of train operation safety supervision in government and China Railway Corporation,put forward the problems existing in train operation safety supervision in the National Railway Administration.Through the above analysis and drawing on the experience of other industries in formulating regulations,this paper put forward relevant suggestions to improve the existing rules and regulations,constructs the system of train operation safety supervision,and provides relevant references for the National Railway Administration to have effective supervision for the train operation safety system.
