摘要
本文以香港《基本法简讯》所载案例为基础,对香港法院适用《香港特别行政区基本法》审理案件的特点及影响进行了系统的内容分析。从样本案例库所反映的情况来看,香港法院基本法诉讼的正当性源于基本法和香港回归后的司法实践,反映出香港司法机构通过积极行使司法权,起到了制约立法机构和行政机构的作用并具有权力扩张的特点。同时,从样本库案例所反映的情况来看,虽然法院对特区立法和行政行为进行了大规模的审查,但最终推翻立法的情况相对较少,并且集中于自始就存在争议的立法或行政决定,反映出司法机构影响政治决策的局限性。
This article provides a systematic content analysis of the Basic Law cases published in the Basic Law Bulletin between 2000 and 2007. Based on the examination of the sample cases,it is argued that the judicial review power in Hong Kong has evolved from the courts' practices after 1997 and that active judicial reviews have resulted in the empowerment of the judiciary and the effective restraint of legislative and administrative powers. On the other hand,judging from the limited numbers of enactments and government orders invalidated by the courts,although the courts have extensive review power,the courts' actual impacts on political decision-making are still restrained.
