摘要
本文简要地介绍了香港法定机构的功能、运作和管治架构,梳理了特区政府对法定机构的各项问责和监管的机制,目的是深化对香港管治特点的认识,并通过对香港权力下放经验的探讨,使内地目前大力推动的"简政放权"从中得到借鉴和启发。香港的经验表明,"大社会"的形成需要政府的培育与扶持:与"大社会"相配套的应该是"强政府"而非"小政府";政府不论是向市场还是向社会放权,其本质都应该是向规则放权。
By briefly introducing the functions,operations and governance framework of statutory bodies in Hong Kong,this paper gives emphasis on the various mechanisms of checks and balances set up by the government to ensure the proper administration of the delegated power.The effective functioning of statutory bodies in Hong Kong sends three key messages to the Mainland which currently is undertaking the streamline of administration and delegation of power to the market and the society.First,the growth of a 'big society' needs the supervision and support of the government.Second,for a big society to function properly,it needs a strong government rather than a small one.Third,whether the power is delegated to the market or to the society,it should be first delegated with detailed regulations as well as checks and balances.
