摘要
香港社会对"8·31决定"提出了诸多质疑,这与法制冲突中两地磨合的大环境以及香港政改争拗的小背景有关。审视这些意见,其中既存在法理误读,也包含政治抵触。就其法律性质而言,该决定毫无疑问具有法效力,香港任何机构没有审查的权力,全国人大也几乎不存在改变或撤销的现实可能。就其内容来看,该决定对特首普选框架进行规定符合体系解释和目的解释的结论,并不违反《基本法》和2004年"人大释法"。虽然"8·31决定"与部分人士的期望存在落差,但并未封死香港本地对政改的讨论空间。应该承认这份决定符合香港实际情况,兼顾了中央与香港两地以及香港内部各阶层的根本利益,在其框架内讨论特首普选问题,有利于香港民主制度的长远健康发展。
The August 31 st Decision of the NPCSC has been challenged by some Hong Kong people,which to some extent resulted from the legal conflict between mainland and Hong Kong,as well as the disputes over the constitutional reform in Hong Kong.No doubt,the Decision has legal validity.None of the institutions in Hong Kong has the power to review it.It is also impossible to be altered and annulled by the NPC.With respect to content,the Decision lays down principles for the universal suffrage of the CE,which conforms to structural and teleological interpretation of the Basic Law and the '2004 NPCSC Interpretation'.The Decision may not completely satisfy the expectations of some people,but there is still room for discussion regarding constitutional reform in Hong Kong.We cannot but admit that the Decision is in accordance with realities in Hong Kong.It balances the fundamental interests of both the central government and Hong Kong,and the people in Hong Kong as well.Discussing the universal suffrage of the CE on the basis of this Decision will be beneficial to the long-term constitutional development in Hong Kong.
